Synopsis
This amendment makes it clear that DelDOT does not have the authority to condemn land for bike trails that are not adjacent to streets. Without this amendment HB 144 would allow DelDOT to condemn land for bike trails through the private or public open space of neighborhood subdivisions or on any other privately owned land. Current law in Title 17 Chapter 10 titled “Bikeways and Safe Routes to School” does not include the power of condemnation for bike trails.
